“Turnkey” is not legally defined. We explain what the building specification must contain, the 12 most frequent disputes, when DIY pays and how to recognise a sound fixed-price contract.

“Turnkey” sounds like a worry-free package – but it is not clearly defined legally anywhere. Each provider interprets the term differently, and the scope ranges from really ready to move in to “walls are up, nothing else”. This guide shows what the construction and performance specifications must contain in 2026, which twelve points of contention arise most frequently and how you can recognize a watertight fixed-price contract.

What does “turnkey” really mean legally?

In brief: The term turnkey construction is not defined in Germany in 2026 in either the BGB or the VOB. He describes colloquially that the house is "fully usable upon handover" - which varies in detail. Therefore, never just read the term “turnkey” – always ask for the complete construction and service description, position by position. A good brand provider will provide a 30 to 60 page BLB with every detail from the brand of roof tiles to the number of sockets.

Construction and service description (BLB): The most important 18 positions

In brief: A complete BLB contains at least 18 main items in 2026, each with quantities, material quality and brand information. If only one main position is missing, conflict is inevitable. The most important: earthworks/floor slab, shell, roof, windows/doors, heating/plumbing, electrical, drywall/plaster, screed, floor coverings, painters/wallpapers, sanitary objects, interior doors, stairs, chimney/extractor hood, exterior painting, exterior doors, energy certificate, construction management.

Only compare BLBs between providers after you have made identical specifications (same m², same KfW level, same equipment class). Otherwise you are comparing apples with oranges. Brand providers such as Bien-Zenker, Schwabenhaus, FingerHaus or OKAL provide a clearly structured BLB as a PDF upon request.

The 12 most common points of contention in turnkey construction

In brief: The most common points of contention in 2026 are: additional floor class costs, special requests during the construction phase, painting and floor work, sanitary objects, outdoor facilities, carport/garage, development costs, KfW application, construction time delays, lists of defects upon acceptance, final payment and remaining services, warranty. Most of these can be avoided by having a clear BLB and an independent building expert before signing the contract.

Attention soil classes

The soil class is determined in the soil report (see Property Guide ). Providers often calculate their fixed prices up to soil class 4. If you find “soil class 3 accepted” in the contract without obligation, you risk additional costs of 4,000 to 12,000 euros at the groundbreaking ceremony. Ask for either a fixed price up to soil class 5/6 OR a clear surcharge per m³ of additional excavation.

Fixed price guarantee: How waterproof is it really?

In brief: A fixed price guarantee obliges the provider to adhere to the agreed price regardless of material and labor cost developments. The usual fixed price is 12 to 24 months from the signing of the contract. Be careful with longer lead times: providers often reserve the right to adjust prices after 18 months (index clause). Delete this clause or negotiate a surcharge that motivates the provider to deliver at a fixed price.

The most important fixed price clauses that you should check in the contract in 2026:

  • Fixed price period of validity from the signing of the contract (usually 12-24 months, premium providers up to 36 months).
  • Price index clause: If yes, linked to which index (construction price index Destatis), threshold (>3%), maximum premium (3–5%).
  • Floor class reservation: up to BK 4 or BK 6 included in the fixed price.
  • Special requests: Clear surcharge price list or transparent hourly rate.
  • Delay penalties: If construction time is exceeded - who is liable, how high is the rental fee (typically 80-120 €/day).
  • Insolvency protection: property developer insolvency insurance or contract performance guarantee (5% of the construction sum).
  • Warranty guarantee: 5% of the construction sum as security for a 5-year guarantee.

Plan turnkey house construction with a fixed price means contractually transferring material and labor cost risks to the general contractor - the most important prerequisite for a reliable calculation until move-in.

Meaningful personal contribution: What is worthwhile, what will be expensive?

In brief: Personal contribution (“muscle mortgage”) saves 8 to 22 percent of the construction cost, but requires realistic self-assessment. Worthwhile in 2026: painting/papering work, laying floor coverings, outdoor facilities, setting interior doors, kitchen assembly, lamp connection, garden and fence. Risky for laypeople: plumbing, electrical, heating, screed - mistakes often cost more than the savings. Banks recognize up to 15 percent of your own contribution as equity if you submit a detailed personal contribution plan.

Carry out the house inspection correctly: defects, protocol, final payment

In brief: The house acceptance will be the legally decisive moment of the construction contract in 2026: This is when the five-year warranty according to the German Civil Code (BGB) begins and the remaining payment is due. You must be accompanied by an independent building expert at the appointment (fee €600 to €1,200). A professional defect report documents all defects in a comprehensible manner and makes later claims legally secure.

The most common defects during the 2026 acceptance test: cracks in the plaster, leaky window connections, faulty tile joints, tolerance deviations in walls and ceilings, missing or incorrect sanitary objects, poor ventilation functionality, loss of pressure in the heating system, leaky roof connections, damaged floor coverings. A construction expert systematically checks according to DIN 18202 (tolerances in building construction) and DIN 18203 (dimensional tolerances for finished parts).

Negotiate security deposit

Agree on a security deposit of 5 percent of the construction sum or a corresponding bank guarantee in the contract. The retention will only be paid after the defect has been completely eliminated. Without this clause, after the final payment you only have the BGB warranty right - that is slow and prone to conflict.

In brief: In 2026, turnkey is the right choice for builders with clear deadline pressure (avoid loss of rent), workload (no time for construction management) or a lack of craftsmanship experience. On the other hand, if you have construction time, have technical skills and can shoulder 4 to 8 months of interior work yourself, a converted house will be 15 to 25 percent cheaper. The middle solution is a "turnkey solution without a painter/floor" that saves 6,000 to 14,000 euros and only requires a manageable amount of personal effort.
