The NBauO enables a simplified procedure in accordance with Section 63 NBauO for residential buildings up to building class 2. In development plan areas without exemptions, the permit-exemption procedure is often possible.

Important requirements

  • Distance areas: 0.5 H, at least 3 m (slightly more conservative than BW/Bavaria)
  • Parking space requirement usually 1 per residential unit, different for municipalities
  • Storm loads near the coast (East Frisia, Wesermarsch) must be observed
  • Building Energy Act (GEG) minimum standard, KfW Efficiency House 40 is not mandatory
